Italian regulatory agency: ChatGPT will be unbanned locally if data regulatory requirements are met

News on April 13th, on Wednesday, local time, Italian regulators imposed a series of requirements on OpenAI, the company that created the chatbot ChatGPT, to help to ease their concerns. If these requirements are met, ChatGPT is expected to be back online in Italy.

On March 31, local time, OpenAI, supported by Microsoft, was forced to take ChatGPT offline in Italy. Previously, Italian data protection agency Garante temporarily restricted ChatGPT’s ability to process personal data of users in the country and began an investigation into its alleged violations of privacy rules.

In a statement on Wednesday, Garante laid out a series of "concrete" demands that he hopes OpenAI will meet by the end of the month. The agency said: "Only in this case will the regulator lift the temporary restrictions on OpenAI's use of Italian user data, and ChatGPT can be launched in Italy again."

OpenAI did not immediately respond to a request for comment. . Italy was the first Western European country to ban ChatGPT, but the chatbot’s popularity has attracted the attention of lawmakers and regulators in several countries.

Many experts say new regulations are needed to govern artificial intelligence because the technology could have negative impacts on national security, jobs and education.

Garante said in the statement that OpenAI needs to inform Italian users of the "methodology and logic" behind the data processing required to run ChatGPT.

The regulator also asked OpenAI to provide tools that enable people involved in the data, including non-users, to request that inaccurate personal data generated by the service be corrected, or that it be deleted if correction cannot be made.

Additionally, OpenAI should allow non-users to object to the processing of their personal data to run its algorithms “in a simple and easy way.” Garante also gave the company until the end of September to roll out an age verification system that would block access to users under 13.

Garante also stated that they will continue to investigate possible violations of data protection rules by OpenAI and reserve the right to take any other necessary measures at the conclusion of the ongoing investigation.

Italy’s move to ban ChatGPT has piqued the interest of other privacy regulators in Europe, which are examining whether tougher measures on chatbots are needed and whether coordinated action is needed.

Spain’s data protection agency asked the EU privacy watchdog to assess the privacy issues surrounding ChatGPT.

In February this year, Italian regulators banned the artificial intelligence chatbot company Replika from using the personal data of Italian users, citing the dangers faced by minors and emotionally vulnerable users.
