Bitnomial 於週一向美國德克薩斯州南區地方法院提起的訴訟對 SEC 聲稱 XRP 期貨是「證券期貨」的說法提出了異議，這將使它們受到該機構的管轄。

此次法律行動是在 Ripple 與 SEC 就 XRP 分類問題進行持續鬥爭之後進行的，Bitnomial 目前正在尋求明確哪個監管機構對加密衍生品擁有管轄權。

Bitnomial 在訴訟中聲稱，SEC 將 XRP 期貨標記為“證券期貨”，這超出了其界限，這將使它們受到 SEC 和商品期貨交易委員會 (CFTC) 的聯合監管。

在聯邦法官裁定二級市場上的 XRP 銷售不構成證券後不久，該交易所於 8 月申請批准 XRP 美元期貨合約。

然而，SEC 在提交文件後聯繫了 Bitnomial，表示 XRP 期貨屬於兩個監管機構的管轄範圍，且 Bitnomial 必須遵守額外要求。

根據訴訟，美國證券交易委員會堅持認為，該交易所需要在提供期貨合約之前註冊為國家證券交易所。

Bitnomial 不同意 SEC 對 XRP 的分類，認為數位資產不是投資合約，應該由 CFTC 而非 SEC 監管。該訴訟要求法院裁定 XRP 期貨不是證券期貨，並阻止 SEC 執行其主張。
