“This removes the need to issue a ruling as to the sufficiency of the allegations as to those tokens at this time,” the SEC noted.

This means that the government agency is no longer asking the court to decide if the affected tokens are securities. Instead, the SEC will focus on the remaining tokens in its suit against Binance.

Which tokens are affected?

In its suit against Binance, the SEC alleged that several tokens are securities. Among them are BNB BNB , Binance USD (BUSD), Solana SOL , Cardano ADA , Polygon MATIC , Cosmos ATOM , The Sandbox SAND , Decentraland MANA , Axie Infinity AXS and COTI (COTI).

BNB

$574

SOL

$182

ADA

$0.40

MATIC

$0.5241

ATOM

$6.18

SAND

$0.33

MANA

$0.34

AXS

$5.98

These tokens are part of a larger list of tokens that the SEC believes are securities. In June 2023, the SEC alleged that at least 68 tokens met the definition of a security, covering over $100 billion worth of tokens in the crypto market.

Shifting views on crypto in the US

The SEC’s decision to retract its request for a ruling comes amid attempts by presidential candidates to court pro-crypto U.S. voters.

On July 27, former president and candidate Donald Trump pledged to end the “war on crypto” as part of his campaign. Speaking at the Bitcoin 2024 conference in Nashville, Tennessee, Trump said that the U.S. will become the “crypto capital of the planet.”

The Republican candidate also stated that he will fire SEC Chair Gary Gensler on his first day as president and appoint a crypto and Bitcoin presidential advisory council. Trump added that he will appoint a new chairman to help America “build the future, not block the future.”

Meanwhile, shifting views on crypto are also being observed on the other side of the political spectrum. On July 27, Democratic members of the U.S. House of Representatives signed a letter calling for the party to take a “forward-looking approach” to blockchain and digital assets.

In response to the letter, advisors of presidential candidate and incumbent Vice President Kamala Harris contacted crypto companies to mend the party’s ties to the crypto industry.
